California Proposition 65

What is Proposition 65?

Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, is a California law that requires businesses to provide warnings to Californians about significant exposures to chemicals that cause cancer, birth defects, or other reproductive harm. The state maintains a list of over 900 chemicals that fall under this regulation, which is updated annually.

A Proposition 65 warning does not mean a product is in violation of any product-safety standards or requirements. It is a "right-to-know" law intended to ensure that California consumers are fully informed about their potential exposure to certain chemicals.

Why is there a Prop 65 warning on Herbpy supplements?

Many of our dietary supplements feature botanical extracts derived from roots, herbs, and plants, such as Turmeric, Ginger, Dandelion, Amla and others. Because these plants are grown in the earth, they naturally absorb trace amounts of minerals and elements present in the soil and water, including heavy metals like lead, cadmium, and arsenic.

These elements are ubiquitous in the natural environment worldwide. Consequently, virtually all natural, soil-grown botanical ingredients contain low, naturally occurring levels of these substances.

Herbpy manufactures all products in FDA-registered facilities that are GMP-certified (21 CFR Part 111) by Eurofins. Production also meets ISO (22000:2018) and Halal Standard (GSO 2055-1:2015 & MS 1500:2019) requirements. Our ingredients undergo strict third-party analytical testing to ensure they meet federal safety guidelines and fall well within the safe consumption limits established by the FDA, the World Health Organization (WHO), and the United States Pharmacopeia (USP).​

How do California's standards compare to federal standards?

California’s Proposition 65 sets safety thresholds that are significantly more stringent than those of federal and international regulatory agencies.

For example, the Proposition 65 Maximum Allowable Dose Level (MADL) for lead is set at 0.5 micrograms per day. To put this in perspective, this threshold is up to 50 times lower than the safety standards established by the FDA and other global health authorities for daily dietary intake. Because herbal extracts are concentrated forms of natural plants, taking a standard daily serving of certain botanical supplements can sometimes exceed this microscopic 0.5-microgram threshold, triggering the warning requirement in California.
